Article 1: Scope of application

The purpose of these general terms and conditions of sale is to govern the contractual relationship between SAS TOP SELLERIE (hereinafter referred to as "us"), whose address is 1, rue du Cours - 61500 SÉES - FRANCE (RCS Alençon 413 768 136) and the author of any order (hereinafter referred to as "you") operated on the www.topsellerieauto.com website.

These general terms and conditions of sale are systematically brought to the attention of each purchaser to enable them to place an order. Consequently, the fact that you confirm your order on the www.topsellerieauto.com website implies your full and unreserved acceptance of these general terms and conditions of sale.

Any condition that is not in accordance with our general terms and conditions of sale that you may formulate will be rejected unless we have expressly recognised its applicability through a written document. We may modify these terms and conditions of sale at any time, provided that we publish these modifications on our website.

Article 2: Ordering

We undertake to accept your order under the terms of these general conditions of sale.

Please note that we will respond to your order within the limits of our available stocks and/or within the limits of our suppliers' available stocks.

When you place your order, we will inform you of the availability of the products you wish to purchase. Nevertheless, if despite our vigilance the products turn out to be temporarily unavailable (shortage of stock, suppliers, etc.) after your order, we will inform you by e-mail and invite you to cancel or modify your order.

If the products are permanently unavailable after you have placed your order, we will automatically cancel your order and inform you by e-mail.

By confirming your order, you accept all of these general terms and conditions of sale made available to you on the site, and acknowledge that you are fully aware of them, the act of purchasing implying acceptance of these general terms and conditions of sale.

Article 3: Prices

The prices indicated in euros are deemed to include all taxes (except outside the EU) and exclude customs duties.

We reserve the right to modify our prices at any time, but we undertake to apply the current prices indicated at the time of your order. 

Article 4: Payment

The price is due immediately at the time of the order and payment is made by credit card or by using a PayPal account. In the case of an order paid for by bank transfer, the order will be registered on the date of reception of the payment. 

Cards issued by banks domiciled outside France must be international bank cards.

Payment by credit card is secured by the PAYBOX service. Your banking information is directly treated on the waiter of PAYBOX, this information is never brought to the knowledge of TOP SELLERIE.

Article 5: Delivery

Except otherwise stated, the delivery is carried out at the address of delivery which you indicated at the time of your order. The goods are transported at the risk of the recipient. In the event that the parcel received is damaged, we kindly ask you to make a complaint to the delivery driver at the time of delivery.

In the case of an order paid for by bank transfer, the delivery date will be valid starting on the date of receipt of the payment. 

Article 6: Products

Any modification concerning the product ( the removal of a material reference, the suppression of embroidery, or in general any other change) cannot be contested if it is expressly mentioned on the home page of our website.

The brands of the car manufacturers indicated on our site are only used to indicate a model with which the item offered is compatible and do not imply any affiliation with the manufacturers or their networks.

Article 7: Returns and refunds

In accordance with article L.121-20 of the French Consumer Code, the consumer has a period of fourteen days in which to exercise their right of withdrawal without having to justify their decision or pay any penalties, with the exception, if applicable, of the cost of returning the goods.

The customer may waive this period in the event that he is unable to travel and at the same time has to call upon a service that is immediate and necessary for his living conditions. In this case, they may continue to exercise their right of withdrawal without having to justify their decision or pay any penalties.

This period runs from receipt of the goods ordered. You will nevertheless be responsible for the cost of returning the goods, unless the return is due to an error on our part.

Only products returned in their entirety (accompanied by the invoice number to which it relates), in good condition and in their original packaging as delivered by us will be taken back or exchanged.

Nevertheless, and in accordance with the provisions of article L 121-20 of the French Consumer Code, an item cannot be returned by the customer if, having chosen a personalised (that is to say, made-to-measure) version, he or she does not find the item to his or her liking.

In all the other cases, the products will have to be turned over to the following address: TOP SELLERIE - 1, rue du Cours - 61500 SÉES - FRANCE. At the end of this period, the products delivered will be deemed to be in conformity with your order and accepted by you.

Article 8: Retention of title

The goods delivered shall remain our property until you have fulfilled all your obligations towards us and in particular until full payment of the price, plus interest if applicable.

This retention of title does not prevent the transfer of risks, which will be your responsibility from the date on which the products ordered will have departed from our premises in accordance with the provisions of Article 5.

Article 9: Guarantee against hidden defects and responsibility

In the event that the products we have delivered to you have a latent defect, we may, at our discretion, repair the defect or replace the defective product with another. If we do not wish to eliminate the defect or replace the defective product, or if we are unable to do so, or if we are unable to do so within the time limit due to factors beyond our control, you may, at your option, return the product to us against refund of the price and return costs or ask us to reduce the sale price.

The products offered comply with current French legislation. We decline all responsibility in the event that the product delivered does not comply with the legislation of the country of delivery.

Top Sellerie cannot be held responsible for damage of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products sold.

Likewise, we cannot be held responsible for the content of sites to which hypertext links may lead from our site.  

We commit ourselves to taking all the care and attention in our profession to provide the service offered to the customer. Nevertheless, we shall not be held liable in the event of failure to fulfil our contractual obligations due to an incident or event of force majeure such as natural disasters, fires, floods, wars, riots, strikes, accidents and the impossibility of obtaining supplies.

Article 10: Protection of personal data

We are committed to protecting your personal data.

Any personal data we have collected about you is treated with the strictest confidentiality, in accordance with the conditions of our personal data protection policy. When you make a purchase, we only ask you for informations that are essential to ensure the quality of our services and the processing of your order. We do not sell, market or rent this information to third parties.

By accepting these general terms and conditions of sale, you acknowledge that you have read our personal data protection policy and consent to the collection and use of this data.

Article 11: Applicable law and jurisdiction

These terms and conditions of sale are governed by French law and the Vienna Convention on Contracts for the International Sale of Goods, to the exclusion of United Nations sales law.

All disputes relating to the commercial relationship between you and us are subject to the exclusive jurisdiction of the French courts, unless you request otherwise if you reside outside French territory.

Article 12: Intellectual property

The whole website is subject to French and international legislation on copyright and intellectual property. All reproduction rights are reserved, including for downloadable documents and iconographic and photographic representations. Reproduction of all or part of the website on any medium whatsoever is strictly prohibited without the express authorisation of TOP SELLERIE.

Despite all the care taken in the creation of this site and its regular updating, errors may have crept into the information and/or documents presented. Users of the site should therefore make any necessary checks.
